User Agreement
The text below is our user site agreement. These are the terms and conditions
required for access to our site. Please read completely before deciding to
agree or disagree with these terms.
MYTERRA RANCH
ONLINE PRODUCTION SALE
OCTOBER 1 TO OCTOBER 9, 2011
TERMS AND CONDITIONS
By registering for this auction you agree to the following Terms and Conditions that shall govern this online auction.
1.Bidder Registration
Only persons who can enter into legally binding contracts under applicable law may register and bid. If you are registering as an agent or using a business name, you represent that you have authority to bind same to these Terms and Conditions.
You are responsible for providing accurate registration information that will be used to identify you to this online auction and allow Myterra Ranch to contact you. Your personal information will be protected as stated herein under the Privacy Policy (see #11).
Myterra Ranch reserves the right to approve/disapprove any bidder application. You will be banned from this auction if you provide false registration information.
2.Web Site Information
Every effort has been made to ensure the correctness of the online sale information. Known defects will be stated at listing time. Myterra believes the descriptions of horses appearing in this online auction and in advertising for this auction are correct.
Myterra Ranch reserves the right to withdraw a lot after being listed if necessary at the time.
3.Reserve Price
A reserve price is the lowest price at which a horse will be sold. The reserve price will not be disclosed to bidders, but when the reserve price has been met the auction site will say “Reserve Price Met” and then the horse will be sold to the highest bidder. If the reserve price is not met the horse will not be sold.
4.Bidding
All bids are in Canadian dollars. All bidding will be done on the Internet by registered and approved Bidders. As an active bidder you are responsible to monitor bidding activity.
If a bid is the high/winning bid, that Bidder will be obligated to buy the lot at said price indicated. Placing a bid at this auction, winning, then not paying for the lot is illegal and prosecution can result.
As a Bidder, you are responsible for any bids placed by you or your representative under your bidding name/number and password. The security of your Bidder information is your sole responsibility and the Bidder will be responsible for any and all bids placed under the assigned name. If, at any time, you feel that your Bidder name/number and password have been compromised due to lack of security on your part, notify Myterra Ranch immediately.
5.Absentee Bidding
Absentee bidding means a bidder can enter a maximum bid amount and the auction will automatically bid in their absence, executing their bid for them and trying to keep the bid price as low as possible. A bidder doesn’t have to watch the auction every minute to make sure they are not outbid.
6.Bid Retractions
A submitted bid can not be cancelled. Once a bid is made and confirmed it can not be retracted. When a bid is made you manifest your intent and ability to buy the lot at the bid price.
7.Bid Closing
Bidding will end for all lots in the sale at 6:00 pm Mountain Daylight time on October 9, 2011. The auction software will extend the ending time of the auction if there is active bidding taking place.
If a lot is closed, no more bids will be taken. The highest bidder becomes the Buyer. Title passes immediately to the highest bidder (Buyer) of the closed lot. Horses are at the Buyer’s risk and responsibility from the time or purchase, but there will be no pick up or delivery until final settlement has been made. All bids and purchases are a binding contract between Bidder/Buyer and Myterra Ranch and shall be equally binding between both parties.
8.Settlement
Settlement is in Canadian dollars immediately after a sale lot is closed. Each Buyer, following his/her purchase will receive an Acknowledgement of Purchase via email outlining the details of the transaction.
The total amount of the selling price is due and payable to Myterra Ranch, no later than the end of the fifth (5th) business day after the bidding closes on the last day of the sale. If the Buyer has not made payment to Myterra Ranch within the time frame noted above, it will be considered a default sale. Myterra Ranch reserves the full power and right to resell the horse to their best advantage, either publicly or privately, without further notice. Any loss resulting from such resale and all other expenses incurred as a result of the default are payable by the default Buyer (Original Buyer).
Buyers intending to write personal or business cheques must provide a reference from their bank to verify their credit worthiness.
Payment for purchase of horse(s) may be made in the following ways:
• Paypal (a 3.0% surcharge will be applied to all Paypal payments)
• Certified cheque
• Bank draft
• Money order
• Personal/Business cheque
Purchases will be subject to Canada’s Generalized Sales Tax (GST) of 5%.
9.Title and Delivery
Title and all risks are assumed immediately by the high bidder (Buyer) at the end of the designated bidding time for the sale. All risk of death, damage, or injury to each lot becomes the Buyer’s risk.
Transportation is the sole responsibility of the Buyer. Horses will be boarded free of charge for 14 days from the last day of the sale unless other arrangements are made with Myterra Ranch at which time board charges will accrue.
10.Registration Papers
Registrations papers, transfers, breeder’s certificates or registrations applications will be transferred to Buyer after all cheques, wire transfers, credit card charges and fees have cleared the bank and/or after acceptance of final payment. Buyer is responsible for any registration and/or transfer fees.
11.Privacy Policy
By registering you are agreeing to the use of your information by Myterra Ranch. Your information will only be used by Myterra Ranch for record keeping and to contact you. Myterra Ranch will not give or sell your information to any entity. In the future we may use your email to contact you.
